Driving Under the Influence (offenders younger than 21years old):
- Class C Misdemeanor, a fine not to exceed $500.00.
Driving while Intoxicated, Boating while intoxicated or flying while intoxicated, 1st Offense:
- Class B Misdemeanor, no less than 3 or more than 180 days in the county jail and a fine not to exceed $ 2,000.00.
Driving while Intoxicated, Boating while intoxicated or flying while intoxicated, 2nd Offense:
- Class A Misdemeanor, not less than 10 days or more than 365 days in the county jail and a fine not to exceed $ 4,000.00.
Driving while Intoxicated, Boating while intoxicated or flying while intoxciated, 3rd (or more) Offense:
- Third Degree Felony, 2 to 10 years in the Texas Department of Criminal Justice, Institutional Division and a Fine not to exceed $10,000.
Intoxicated Assault, Third Degree Felony:
- 2 to 10 years in the Texas Department of Criminal Justice, Institutional Division and a fine not to exceed $10,000. Note, if there is a finding that a deadly weapon, i.e. a motor vehicle, was used during the commission of the offense, one-half of any prison sentence must be served before one is eligible for parole. Furthermore, only a Jury can grant probation with a deadly weapon finding.
Intoxicated Manslaughter, Second Degree Felony:
- 2 to 20 years in the Texas Department of Criminal Justice, Institutional Division and a fine not to exceed $10,000. Strong possibility of a deadly weapon finding.
